Piracy is not theft, it's copyright infringement. As in making or distributing a copy of copyrighted material. I am not a lawyer, but I don't think the copyrighted work needs to be on sale for unauthorized copy to be illegal.

Although if you're not paying for something that normally costs something, that's considered theft by most people's standards, that's why it's called 'piracy'

I directly contradicted you. I'm pretty sure it IS illegal and piracy, even if it's not for sale. That's why abandonware is a moral gray area, because even if there's nowhere you can buy it, it's still illegal to copy/distribute it.
