Uuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuh, this statement is just so incredibly wrong, people have always been building upon others ideas when it comes to gaming and most of the time done their best to improve on the formula, that's just how the gaming industry works.

No, I'd say that's how the world works. All ideas come from somewhere and simply having the same idea doesn't mean it's necessarily derivative because it's the subtle details and the general execution that really matters. For example, I would say that Deus Ex: Human Revolution and Robocop are pretty much the same fundamental story on the surface. Mainly: Guy gets augmented against his will to save his life, loses his loved ones and it's set in a dystopian crime-filled Detroit. Hell, they even make a direct reference to Robocop at one point. Does that mean that Deus Ex: HR is a rip-off? No, because they did something completely different with it and it ends up being nothing like Robocop. Art and entertainment are always about the subtleties of the directing and writing.
