It's not necessarily illegal to use assets without permission if they are not of a copyrighted material. However, since Call Of Duty IS A REGISTERED, COPYRIGHTED and TRADEMARKED company, unless you have explicit permissions to use their assets, materials and/or content, you are in violation of copyright.

For projects which will not leave your own possession, yes. You may do whatever, however if you post or publish your work anywhere, claiming to have done everything, you are subject to some very serious charges.

Taking someone's work and modifying some aspect of it to claim it as your own is still illegal. Furthermore, in very serious cases, can and will get you involved in a lawsuit.

If you are seriously considering using the Ray Gun in any way for a custom story, full conversion or modification to be released using the Amnesia engine, Stop. Right now. Just don't do it. You will be banned from here, and will likely face consequences on other websites.

DO NOT EVER assume that just because you modify something on someone elses work, you will get away with it.

That's all I will say. Either read it and understand what you're doing fully before proceeding, or just drop that particular part of your mod. It's a battle you will not win.
