As I have understood it "the Fair Use act" does not relate at all to what is being discussed. :>

Typically, if say a mod of a game uses a song from so-and-so, as long as they are credited for their work then there is no issue. Again, usually only as long as no profit is being made.
Giving credit while distributing someone else's work does not make it legal either Smile Where do you get your ideas from?

As for using models (without permission); it's illegal. Distributing someone else's property (models within a game are the respective owners property) is piracy, even if it's all "for free".


I would suggest looking for models which are "free to use", instead of models from games. Less trouble, but probably a little more work. The Dark Room series is given quite a lot of attention, so I'd try to stay in a "legal area" - as bigger things cause a bigger ruckus if found wrong/illegal.
