If it is unofficial, they have to follow certain guidelines for a proper legal approval. If I had an android or the patience to look at the app, I would assume that they may have.

Think of it like using the scenario of Pokemon - you're given one, go catch more, train them, battle them, become tough, show the bad guys who's boss, etc. Someone can make an 'unofficial' Pokemon game by using that same mechanic, however redesigning everything to the point where it is unrecognizable as a Pokemon game.
