quick question

if you have a polygon that has only 4 sides but one of the sides has an extra verticy somewhere along it, will it be count that as a 5 sided polygon? im just wondering cause im not sure if 3ds max will automatically render it as two sides even if all 3 vertices are in a straight line

I'd say that if the vertex doesn't change the shape of the model itself (just moving it a bit in any direction would do) the program should render it as a 4 vertex polygon. I think.

It will render it as a 5 sided polygon, because the polygon does have 5 vertices that the program need to calculate. So unless there's a reason for it, I'd suggest not to do that because it's slower.
